成德眉资全国首创合规容错清单，这些情况不予处罚

PingFangSC-Light;'>什么情形下经营者“不按规定明码标价”不予处罚？<strong>“初次违法”“及时改正”“危害后果轻微”</strong>，《清单》要求必须同时满足这三个条件，并对哪种程度是“危害后果轻微”进行了明确——违法行为持续时间不足3个月，能够如实提供相应商品或服务的价格资料，未对消费者权益造成实质损害。</span></p><p PingFangSC-Light;'>“新版《清单》提供了更明确的基层执法指引，将进一步推进柔性执法落地见效，为辖区各类经营主体提供更加包容的法治环境。”该负责人强调，《清单》的另一大亮点是首创例外情形，明确了包容监管和审慎监管边界，对损害消费者权益的违法行为“择重处罚”。</span></p><p style='text-align:justify;margin-bottom: PingFangSC-Light;'>“原违法行为可能与其他较重行为竞合情形，将较重的作为例外情形，也就是说，如果有较重行为，将依据行政处罚法择一重处原则进行处罚，让经营主体知晓违法后果的严重性。”该负责人以电子秤未强制检定为例进行解释，“责令送检后，如果合格，则从轻处罚；但如果不合格，则会从重。”</span></p><p PingFangSC-Light;'>《清单》适用对象还特别关注了小微民营企业、个体户、小摊贩等，如对“食品生产经营者未按照规定在显著位置张贴或者公开展示相关监督检查结果记录表”行为实施不予处罚的重点关注对象是“小微食品生产企业”；对“经营的食品标签、说明书存在瑕疵但不影响食品安全且不会对消费者造成误导”行为实施不予处罚的重点关注对象是“城中村和农村小型超市、商店”。</span></p><p
