2em;'>经法院审理查明，被告人王某1、王某2在禁渔期使用电击的方法捕捞水产品，情节严重，其行为均已触犯刑律，构成非法捕捞水产品罪，判处王某1拘役六个月，缓刑八个月；判处王某2拘役5个月，缓刑7个月。</p><p><br></p><p style='text-indent: 2em;'>为认真贯彻落实中央、省、市关于长江流域重点水域禁捕退捕决策部署，保护我市天然水域水生生物资源，维护禁捕水域垂钓秩序，根据《中华人民共和国渔业法》《中华人民共和国长江保护法》《四川省〈中华人民共和国渔业法〉实施办法》等法律法规及《最高人民法院、最高人民检察院、公安部、农业农村部关于印发<依法惩治长江流域非法捕捞等违法犯罪的意见>的通知》《农业农村部办公厅关于进一步加强长江流域垂钓管理工作的意见》《四川省农业农村厅关于印发<四川省长江流域禁捕水域休闲垂钓管理办法（试行）>的通知》规定，结合我市实际，制定本办法。</p><p><br></p><p><strong>第一条</strong>在我市天然水域垂钓适用于本办法的规定。</p><p><br></p><p><strong>第二条</strong>本办法所称天然水域是指除池塘、水库、稻田、滩涂等养殖水域以外的其它公共水域。</p><p><br></p><p><strong>第三条</strong>本办法所称垂钓是指在天然水域从事休闲垂钓的行为。</p><p><br></p><p><strong>第四条</strong>禁钓区：水生生物保护区和地表水饮用水水源一级保护区。</p><p><br></p><p><strong>第五条</strong>禁钓期：每年3月1日零时起至6月30日24时止。</p><p><br></p><p><strong>第六条</strong>水生生物保护区和地表水饮用水水源一级保护区常年禁止垂钓。因科研、资源监测、引种需要经批准除外。</p><p><br></p><p><strong>第七条</strong>禁钓区、禁钓期之外可进行休闲性垂钓。每名垂钓人员可允许一竿、一线、鱼钩钩尖总数不超过两个的钓具（单钩钩尖到钩柄的距离不超过2厘米）进行垂钓。垂钓的渔获物及其制品禁止交易，有交易行为的视为非法捕捞。</p><p><br></p><p><strong>第八条</strong>禁止垂钓国家和省级重点保护的水生野生动物。若误钓，应避免受伤并立即放回原水体。若重点保护水生野生动物受伤严重的，应及时报告属地渔业行政主管部门，开展收容救护工作。</p><p><br></p><p><strong>第九条</strong>垂钓者每人每天留取的渔获物重量不得超过2.5千克，超出部分应当立即放回原水体。若钓获单尾（只）重量超过2.5千克的，可以留取，其他渔获物应当立即放回原水体（外来入侵物种除外）。列入《国家重点管理外来入侵物种名录》《中国外来入侵物种名单》的种类不纳入钓获物管理。</p><p><br></p><p><strong>第十条</strong>禁止使用下列工具和方法进行垂钓。</p><p><br></p><p><strong>（一）</strong>一人多杆、多线多钩、单线多钩等钓具和方法；</p><p><br></p><p><strong>（二）</strong>国家和省公布的禁用渔（钓）具；</p><p><br></p><p><strong>（三）</strong>探鱼、视频辅助、鱼枪、弓弩等设备；</p><p><br></p><p><strong>（四）</strong>船艇、排筏等水上漂浮物及其它水上设施；</p><p><br></p><p><strong>（五）</strong>在地表水饮用水水源准保护区和二级保护区内使用植物、畜禽粪便等窝饵诱料；</p><p><br></p><p><strong>（六）</strong>含有毒有害物质钓饵、窝料、鱼虾类及其它生物体（除蚯蚓外）等。</p><p><br></p><p><strong>第十一条</strong>垂钓人员应具备从事野外垂钓活动的身体条件，自觉携带必要的水上救生设备，主动识别和避开危险区域，自觉做好自身安全防范。 </p><p><br></p><p><strong>第十二条</strong>垂钓人员不得损坏岸边树木及公共基础设施，不得向河道内或岸边乱扔垃圾、投放有毒有害物质和过度投放饵料。垂钓活动结束后，应收集带走因垂钓产生的废弃物。</p><p><br></p><p><strong>第十三条</strong>按照科学规范、有序引导、严格管控原则，各县（区）可探索建立垂钓人员实名登记备案制，建立登记备案信息系统，便于垂钓个人提交登记备案信息。</p><p><br></p><p><strong>第十四条 </strong> 眉山市天然水域垂钓管理工作，由市、县（区）相关部门各司其职：</p><p><br></p><p><strong>（一）</strong>农业农村部门负责垂钓综合管理，依法查处违法违规垂钓行为。</p><p><br></p><p><strong>（二）</strong>生态环境部门负责依法管理地表水饮用水水源保护区垂钓行为。</p><p><br></p><p><strong>（三）</strong>林业部门负责依法管理自然保护区（地）范围内捕捞（包括垂钓）行为。</p><p><br></p><p><strong>（四）</strong>交通运输部门负责依法管理利用水上交通运输设施设备（船、艇、筏等）捕捞（包括垂钓）行为。</p><p><br></p><p><strong>（五）</strong>市场监管部门负责依法管理并查处垂钓的野生渔获物及其制品交易的行为。</p><p><br></p><p><strong>（六）</strong>公安机关负责依法查处阻碍国家工作人员依法执行公务、扰乱社会公共秩序、涉嫌犯罪的垂钓活动等行为。</p><p><br></p><p><strong>（七）</strong>其它相关部门负责依法查处职责范围内的垂钓行为。</p><p><br></p><p><strong>第十五条</strong>违反本办法规定的，按照有关法律法规和规章予以处罚，构成犯罪的，依法追究刑事责任。</p><p><br></p><p><strong>第十六条</strong>垂钓管理部门、机构及其工作人员玩忽职守不履行法定义务、滥用职权、徇私舞弊的，由上级主管部门或者监察机关给予行政处分；构成犯罪的，依法追究刑事责任。</p><p><br></p><p><strong>第十七条</strong>本办法自2022年3月1日起施行，有效期两年。施行期间如遇国省政策调整，按调整后的政策执行。</p></section></section></section></section></section></section><section
