停车场的规划、建设、使用和管理遵循“政府引导、多方参与、有偿使用、共享利用、高效管理、严格执法、社会共治、方便群众”的原则，停车场的规划建设应当以“配建停车设施为主体、公共停车设施为辅助、路内停车泊位为补充”，尽量满足刚性停车需求，控制城区停车泊位规模，加强交通枢纽、医院、旅游景区、大中型商贸设施以及公共活动场所公共停车设施的规划和建设，大力发展智慧停车，逐步缓解停车矛盾，改善城市静态交通秩序。</span></p><p 设置路内临时停车泊位应当符合相关国家标准和下列规定: (一)保障行人、车辆通行及安全; (二)符合区域道路车辆停放总量控制要求; (三)与区域停放车辆供求状况、车辆通行条件和道路承转能力相适应;(四)对路内临时停车泊位的防汛情况进行评估预防; (五)法律、法规、规章规定的其他要求。</span></p><p style='margin-top: 5px;margin-bottom: YaHei;'><strong>第三十条</strong> 停车场经营服务单位可制定停车泊位编码规则，对停车泊位进行统一编码管理，对已设置的停车泊位的数量、停车时段、收费时段、收费标准进行立牌公布。定期组织开展停车资源普查，并将其停车信息纳入本市停车信息系统。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>停车信息系统的信息应当在各行政管理部门之间实现共享，加强停车场的使用和安全管理。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'><strong>第三十一条</strong> 停车收费按照停车场的不同类型，实行不同的定价方式。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;writing-mode: horizontal-tb;text-orientation: mixed;line-height: 2em;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>公共文化、交通、体育、医疗、教育等公共服务设施配套的停车场、点、泊位，具有垄断经营特征的停车场，停车服务费实行政府定价或政府指导价；其他类型停车场、点、泊位实行市场调节价。<br></span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'><strong>第三十二条 </strong>实行政府定价的停车场，停车场经营服务单位应当按照价格行政管理部门核定的收费标准收取停车服务费，不得擅自提价。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: 住房城乡建设行政主管部门应当及时查处违法设置路内临时停车泊位的行为，加强对非机动车路内临时停放场（点）的管理，并对非机动车在人行道的停放秩序进行监督检查，及时查处共享单车和其他非机动车驾驶人违法停放车辆的行为，督促共享单车经营单位履行管理义务。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'><strong>第四十条</strong> 停车场管理工作应当建立行政执法巡查通报制度。发展改革、住房城乡建设、公安机关交通管理等相关行政管理部门在停车场管理的巡查或者行政执法活动中，发现不属于本部门职责范围的违法行为时，应当及时向有权单位通报。接到通报的相关行政管理部门应当及时依法查处违法行为。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'><strong>第四十一条</strong> 住房城乡建设行政主管部门应当向社会公布受理投诉举报的方式，在接到投诉举报后，应当及时进行调查，发现违法行为应当由其他相关行政管理部门查处的，移交相关行政管理部门进行处理。相关行政管理部门对违法行为查处后，应当及时将处理情况向投诉举报人反馈。</span></p><p style='margin-top: YaHei;'>（一）在醒目位置设置统一的停车场标志牌，标明地点名称、车位数量、监督电话，属于经营的，标明收费标准，不得超范围收费，对于按照国家、省、市相关政策属于减免停车费的车辆，在标志牌上应当予以明示；</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（二）制定车辆停放、安全保卫、消防、防汛等管理制度；</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（三）配置智能化停车管理系统和完备的照明、消防、监控等设备；</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（四）加强对停车泊位的维护，保持标志标线清晰，确保停车设施完好，场地整洁，维护停车场内车辆停放和行驶秩序，消防通道畅通；</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（五）按照停车信息化管理要求，向智慧停车信息平台实时准确上传泊位使用情况、收费管理等数据；</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（六）在收取机动车辆停放服务费时，应向机动车辆停放者出具由税务部门监制的合法票据。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'><strong>第四十三条</strong> 符合下列情形之一的，机动车停放者可以拒付停车费，并向相关管理部门举报：</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（二）故意损坏、偷窃路内临时停车泊位设施；</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（三）擅自拆除、迁移、占用或者改动路内临时停车泊位设施；</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（四）擅自在路内临时停车泊位设施上粘贴或者悬挂广告、招牌、标语或者其他物品；</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（五）在路内临时停车泊位设施上涂抹、刻划；</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（六）其他危害路内临时停车泊位设施的行为。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'><strong>第四十五条</strong> 因城市基础设施建设或者大型群体性活动需要临时占用路内临时停车泊位或者非机动车停放场（点）的，应当由公安机关交通管理部门或者住房城乡建设行政主管部门提前向社会公告。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'><strong>第四十六条</strong> 消防救援机构应当指导停车场经营服务单位划设消防通道禁停区域、设置消防通道标志标识。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>对违法占用消防车通道和消防车登高作业场地停车的，停车场经营服务单位应当予以劝阻、制止，对不听劝阻或者制止的，应当及时报告所在地消防救援机构。</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft YaHei;'>（三）不得违法停放装有易燃、易爆、有毒、有害等危险品的机动车；</span></p><p style='margin-top: 5px;margin-bottom: 5px;font-size: 16px;line-height: 2em;writing-mode: horizontal-tb;text-orientation: mixed;font-family: sans-serif;'><span style='letter-spacing: 2px;font-size: 14px;font-family: 微软雅黑, Microsoft 本来就是建筑红线内的，而且都是自己修的
整治公共车位占为已有的才是硬道理，特别是拿电瓶车和三轮车，桌椅板凳之类，这类人最讨厌。
