style="font-size: 16px;font-family: Helvetica, Arial, sans-serif;">经查，2023年3月初，彭某某连续两天到洪雅县某住宅小区外观察踩点，发现小区某栋2单元102号房屋平时无人居住。</span></p><p style="margin-bottom: 20px;margin-left: 5px;margin-right: 5px;line-height: 2em;"><span style="font-size: 16px;font-family: Helvetica, Arial, sans-serif;">3月3日22时许，彭某某拉着行李箱来到房子底楼，用改刀撬开房屋底楼客厅窗户翻窗潜入，并在住宅底楼卧室居住。居住期间，彭某某四处翻找值钱财物但并未找到，他就到客厅酒柜处拿了四瓶鸡尾酒，又到二楼鞋柜旁拿了四罐凉茶，在卧室里饮用。</span></p><p style="text-align: center;"><span class="wxart_image" Helvetica, Arial, sans-serif;">3月5日中午，房屋主人返回家中，彭某某随即逃离现场。</span></p><p style="margin-bottom: 20px;margin-left: 5px;margin-right: 5px;line-height: 2em;"><span style="font-size: 16px;font-family: Helvetica, Arial, sans-serif;">5月初至6月初，觉得自己没有钱用的彭某某又把主意打到了另一小区的建筑工地。</span></p><p style="margin-bottom: 20px;margin-left: 5px;margin-right: 5px;line-height: 2em;"><span style="font-size: 16px;font-family: Helvetica, Arial, sans-serif;">彭某某先后四次来到该小区工地，用钢筋和改刀将已安装上墙的铝合金窗框撬下并盗走，扛出工地，后以每斤5.5元的价格出售给废旧收购站老板陈某某。</span></p><p style="margin-bottom: 20px;margin-left: 5px;margin-right: 5px;line-height: 2em;"><span style="font-size: 16px;font-family: Helvetica, Arial, sans-serif;">经查，彭某某四次盗窃铝合金窗框共336公斤，获赃款约3,700元，所获赃款用于平时开销。案发后，被害人从陈某某废旧收购站处追回了彭某某盗窃并出售的铝合金窗框172公斤。</span></p><p style="margin-bottom: 20px;margin-left: 5px;margin-right: 5px;line-height: 2em;"><span style="font-size: 16px;font-family: Helvetica, Arial, 5px;"><span style="font-size: 16px;font-family: Helvetica, Arial, sans-serif;">法庭审理认为，被告人彭某某以非法占有为目的，秘密窃取他人财物，数额较大，其行为已构成盗窃罪。被告人彭某某入户盗窃且多次实施盗窃，应从重处罚。</span></p><p style="margin-bottom: 20px;margin-left: 5px;margin-right: 5px;"><span style="font-size: 16px;font-family: Helvetica, Arial, sans-serif;">鉴于被告人具有坦白、认罪认罚等从轻情节，</span><strong><span style="font-size: 16px;font-family:
