text-decoration-line: underline; font-family: 微软雅黑, "Microsoft YaHei";"><strong>同桌饮酒之人相互负有相应的安全注意义务</strong></span><span style="color: rgb(63, 63, 63);font-family: 微软雅黑, Microsoft YaHei;">，这种安全注意义务是指同桌人之间应当承担的提醒、劝阻、通知、协助、照顾和救护等义务，且该义务应具有合理性和有效性。</span></p><p style="text-indent: 2em;letter-spacing: 1px;line-height: 2em;"><span style="color: rgb(63, 63, 63);font-family: 微软雅黑, Microsoft YaHei;">法庭认为，本案中，林某作为聚餐的组织者、共饮者以及饮酒后的同行者，且为三人中喝酒最少的人，理应更清醒和理智。但其在明知杨某已经饮用较多啤酒，甚至可能已达到醉酒程度的情况下，对杨某酒后驾车前往彭山唱歌一事未有效阻拦，反而同行，最终酿成杨某当场死亡的事故结果。故酌定林某<strong>承担</strong><strong>10%</strong><strong>的赔偿责任</strong>，约3万6千元。同时，秦某作为共饮者，非组织者，法院酌定其<strong>承担5%的赔偿责任</strong>，约1万8千元。</span></p></section></section></section></section></section><p style="text-indent:43px;"><br></p><p style="text-indent: 0em;line-height: 1.75em;"><strong><span style="background-color: #ffc000;color: #3f3f3f;"><span style="font-size: 15px;font-family: 微软雅黑, Microsoft YaHei;">案件承办法官杨利花特别提醒大家：</span></span><span style="letter-spacing: 1px;
